5. Search and AI Visibility
Elevate may provide services designed to improve how search engines and AI-powered discovery systems discover, interpret, or understand a business or website.
No search engine, AI provider, or third-party platform is controlled by Elevate Design Labs.
Accordingly, Elevate does not guarantee:
- Specific search rankings.
- Placement in AI-generated responses.
- Mentions or citations by AI systems.
- Traffic increases.
- Lead volume.
- Revenue increases.
- Specific conversion results.
Search engines, AI systems, algorithms, indexing behavior, and third-party platforms may change at any time.
6. No Guaranteed Business Results
Elevate designs and implements systems intended to improve business processes, customer experiences, visibility, automation, and digital operations.
Actual outcomes depend on many factors outside Elevate’s control.
Unless expressly stated in a signed written agreement, Elevate does not guarantee a specific number of leads, sales, conversions, rankings, hours saved, revenue increases, cost savings, or other business outcome.
7. Inquiries, Estimates, and Proposals
Submitting a form, requesting an audit, sending an email, or discussing a potential project does not create a client relationship or obligate Elevate to perform services.
Paid work begins only after both parties agree to applicable project terms, which may be contained in a proposal, statement of work, service agreement, invoice, or other written agreement.
If project-specific terms conflict with these website Terms, the project-specific written agreement will control with respect to that project.
8. Project Scope and Changes
The scope of paid work will be described in the applicable proposal, statement of work, or written agreement.
Requests outside the agreed scope may require additional fees, timeline adjustments, or a separate scope of work.
Elevate will communicate material changes before performing billable out-of-scope work whenever reasonably practical.
9. Payment Terms
Unless different terms are stated in a written proposal or agreement, the following standard terms apply.
Project work may require a 50% deposit before work is scheduled or begins.
The remaining project balance is generally due upon substantial completion and before final launch, transfer, deployment, or handoff of completed deliverables.
Invoices are due within 14 calendar days unless otherwise stated.
Deposits are applied toward the total project cost.
Once substantive project work has begun, deposits are generally non-refundable because time and project capacity have already been committed.
If work has not begun, Elevate may determine whether some or all of a deposit can be refunded based on commitments, expenses, or preparation already completed.
Approved third-party purchases, licenses, services, hosting costs, domains, software subscriptions, or other expenses may be billed separately unless expressly included in the project scope.
Elevate may pause work or withhold final handoff on accounts with overdue balances.
10. Cancellations and Project Pauses
Either party may request cancellation or suspension of a project.
The client remains responsible for payment for work already completed, approved expenses, third-party commitments, and any other amounts owed under the applicable agreement.
If a client becomes unresponsive or fails to provide required materials, approvals, access, or feedback for an extended period, Elevate may pause the project and adjust the delivery schedule.
A prolonged pause may require rescheduling based on current availability.
Specific cancellation, rescheduling, or restart fees may be established in a project agreement.
11. Refunds
Because Elevate primarily provides customized professional services, completed work and time already performed are generally not refundable.
Any refund for unperformed work will depend on the applicable project agreement, work already completed, expenses incurred, and other commitments made for the project.
Third-party software, licenses, domains, subscriptions, hosting, and other external purchases are subject to the refund policies of their respective providers and may be non-refundable.
12. Client Responsibilities
Clients are responsible for providing accurate information, timely feedback, approvals, required content, and lawful access to systems or accounts necessary to perform agreed work.
Clients are also responsible for ensuring they have permission to use any logos, images, text, software, data, trademarks, customer information, or other materials they provide to Elevate.
Delays in providing required materials or access may affect project timelines.
13. Intellectual Property
Unless otherwise stated in a written project agreement, clients retain ownership of content, trademarks, logos, data, and materials they provide to Elevate.
Elevate retains ownership of its pre-existing tools, reusable components, internal methods, templates, processes, know-how, software, libraries, and other intellectual property developed independently of a specific client project.
Upon full payment, ownership or licensing rights for custom client deliverables will be governed by the applicable project agreement.
Third-party tools, fonts, software, plugins, frameworks, APIs, stock assets, AI models, and other licensed materials remain subject to their respective licenses and terms.
14. Third-Party Services
Elevate solutions may rely on third-party platforms, APIs, hosting providers, website platforms, AI providers, CRM systems, analytics services, automation tools, or other external technologies.
Elevate is not responsible for outages, price changes, policy changes, discontinued features, security incidents, restrictions, or other actions caused by third-party providers beyond Elevate’s reasonable control.
Additional third-party fees may apply.
15. Website Content
Unless otherwise stated, the text, branding, design, graphics, reports, software, and other original materials available through the Elevate website are owned by or licensed to Elevate Design Labs LLC.
You may not reproduce, distribute, sell, modify, or commercially exploit Elevate content without authorization except where permitted by law.
16. Disclaimer of Warranties
The website, Elevate Pulse, and publicly available content are provided on an “as is” and “as available” basis.

For paid services, any additional liability terms contained in the applicable client agreement will control.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
18. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute relating solely to these website Terms will be handled in an appropriate court located in Illinois unless the parties agree otherwise or applicable law requires a different venue.
Project-specific agreements may contain additional dispute-resolution terms.

Elevate may revise these Terms as the website, services, technology, or business practices evolve.
